The website terms and conditions, together with the privacy statement ("Website Terms") set out the terms of use on which you may make use of our website www.espghan.org (the "Site"), whether as a guest or a registered user. Please read these Website Terms carefully before you use the Site. Your access to and use of our Site is subject to these Website Terms. By using the Site you are deemed to have read and accepted and agree to be bound by the Website Terms. If you do not agree to the Website Terms, please refrain from using our Site.
Information About Us
www.espghan.org is a Site operated by the European Society of Paediatric Gastroenterology Hepatology and Nutrition (ESPGHAN) (we or us). ESPGHAN is an association as per articles 60 et seq. of the Swiss Civil Code and was instituted in Geneva in 2012. The Society operates with its own administrative office based in Geneva, Switzerland. The ESPGHAN Annual Congress in 2021 is organised with the assistance of a service provider: Eurokongress GmbH, Schleissheimer Straße 2, 80333 Munich, Germany.
Accessing Our Site
Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

Every effort has been made to ensure that information supplied on this Site is accurate, but ESPGHAN cannot be held responsible for any errors or omissions therein, nor for the consequences of these or for any loss or damage suffered by users of any of the information published on any of these pages.
We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our Site, or by anyone who may be informed of any of its contents. Furthermore, whilst ESPGHAN endeavours to keep the site up to date, information published may be out of date and readers should check with office@espghan.org before relying on this information.

We aim to update our Site regularly and may change the content at any time. If the need arises, we may suspend access to our Site, or close it indefinitely. Any of the material on our Site may be out of date at any given time, and we are under no obligation to update such material.

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under applicable criminal law. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

Online Payments
Prices and Payment All prices indicated on our Site are in Euro (EUR). Users are enabled to make payments electronically to ESPGHAN by MasterCard (incl. MasterCard Secure Code) and VISA (incl. Verified by VISA). Any transaction fees will be charged to the user directly by the payment instrument provider. If payments are made via bank transfer, any bank charges will be charged to the user. All prices displayed on our Site are inclusive of VAT.
By confirming a transaction, the user agrees that the price will be charged directly to his/her credit card.
Payment Mechanism
The payment will be handled via the payment instrument provider. ESPGHAN will not store, process, or even have access in any way to the user's payment data for any transactions made via the payment instrument provider. The security of transactions is guaranteed by the Secure Socket Layer standard (SSL).
You agree to pay the price applicable to the chosen service (educational event, membership renewal/payment) and will not hold ESPGHAN liable for any charge related to your payment. All credit card information is protected. ESPGHAN guarantees not to duplicate, store, save, capture or intercept payment instruments related information such as credit card numbers, expiry date, holder name, card summary (last 4 digits), card BIN (6 first digits), card type, issuer, issuing country, CVV codes, passwords entered into the payment interface.
The user's credit card information will be transferred to the payment provider as secured data to the payment instrument provider’s server.
ESPGHAN will retain a copy of records related to completed transactions for accounting and auditing purposes only. These records will exclusively reflect the status and amount of the respective payments.
The payment interface provider will assure compliance with the relevant Swiss laws and regulations.
As a user, you hereby authorize and agree that the payment instrument provider shall debit (whether directly or indirectly via a third-party payment service provider, subject to that third-party service provider’s terms of use) your payment card of the amount of the price as stated on our Site.
In order to enable the payment interface provider to comply with applicable laws, ESPGHAN and/or the payment interface provider is/are entitled to request from any user the details, background of the transaction and/or the identity of the beneficial owners of any transaction processed through the Site.
Cancellation and Refund
If you need to cancel/withdraw from a service after payment has been processed (educational event, cancellation of membership), you must notify the ESPGHAN Office who will consider the request relating to any monetary refund of the completed transaction, based on assessment of the individual reason and manner of cancellation. A formal right to refund is however excluded. For any cancellations/withdrawals relating to the ESPGHAN Annual Congress, please contact our service provider: Eurokongress GmbH, Schleissheimer Straße 2, 80333 Munich, Germany.
Jurisdiction and Applicable Law
The Swiss courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Site. These Website Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Switzerland.
